Terms of Service
Effective date: July 17, 2026
These Terms of Service (“Terms”) govern your use of SkaiApply, operated by ClearSkai Technologies (“SkaiApply”, “we”, “us”). By creating an account or using the platform, you agree to these Terms. If you use SkaiApply on behalf of a company, you represent that you have authority to bind that company.
1. What SkaiApply is
SkaiApply is a hiring marketplace for the skilled trades. Candidates create profiles and apply to jobs; employers post jobs, search opted-in talent, and manage applicants. We are a venue: we are not a party to any employment relationship, we do not employ candidates on behalf of employers, and we do not guarantee any hire, job, wage, or outcome.
2. Eligibility and accounts
- You must be at least 18 years old to use SkaiApply.
- You must provide accurate information and keep your account details current. One person per account; you are responsible for activity under your credentials.
- We may suspend or terminate accounts that violate these Terms, applicable law, or that we reasonably believe are fraudulent.
3. Candidates are never charged
Searching, applying, building a profile, and messaging employers are free for candidates. No legitimate employer on SkaiApply will ask you to pay to apply, interview, or start work. If anyone does, report it — see our guide to spotting job scams.
4. Employer obligations
- Job postings must describe real, currently open positions at your company and must be lawful, accurate, and non-misleading.
- You are solely responsible for complying with all applicable employment laws, including equal-opportunity, wage-and-hour, licensing, and workplace-safety laws. Postings may not discriminate on the basis of any legally protected characteristic.
- Candidate data you receive through SkaiApply may be used only for your own hiring. Reselling, scraping, or compiling candidate data is prohibited.
- You may not charge candidates fees, require them to purchase equipment through specific vendors as a condition of hire, or use the platform for multi-level-marketing recruitment.
5. AI-assisted features
SkaiApply provides AI-assisted features, including application fit scores, job recommendations, and job-description drafting. AI outputs are advisory only. They are not hiring decisions, and employers remain fully responsible for their own evaluation of every candidate and for compliance with laws governing automated employment decision tools in their jurisdiction. We design these features to explain their reasoning and to exclude protected characteristics, but no automated system is perfect — do not rely on a score as the sole basis for any employment decision.
6. Verification badges
A “verified” badge means a SkaiApply reviewer looked at a document a candidate submitted (for example, a certification card or license) and found it plausible on its face. It is not a background check, a consumer report, a license-status guarantee, or a substitute for the employer’s own due diligence. Employers must independently verify any credential that matters to a hiring decision.
7. Ratings and reviews
Employers may rate workers they actually hired through the platform, and workers may dispute ratings. Ratings must reflect genuine first-hand experience. We may remove content that is fraudulent, retaliatory, defamatory, or unrelated to work performance.
8. Your content
You own the content you post (profiles, résumés, job listings, messages). You grant SkaiApply a non-exclusive, worldwide license to host, display, and process that content to operate and improve the platform — including processing by AI systems as described in our Privacy Policy. You represent that you have the rights to everything you post.
9. Prohibited conduct
- Fake profiles, fake jobs, impersonation, or misrepresentation
- Harassment, discrimination, or abusive messaging
- Scraping, bulk data collection, or automated access without a written agreement
- Attempting to bypass fees, security controls, or rate limits
- Uploading malware or content you have no right to share
- Using the platform for anything other than trade hiring and related activity
10. Paid services
Employer subscriptions and promotions, where offered, are billed as described at purchase. Except where required by law, fees are non-refundable once the billing period starts. We may change pricing with notice effective at your next renewal.
11. Third-party services
Authentication, hosting, payments, and AI processing are provided by third-party providers. Employers who connect SkaiScraper or other integrations authorize the data exchange those integrations describe.
12. Disclaimers
SkaiApply is provided “as is” without warranties of any kind, express or implied. We do not vet employers or candidates beyond what is expressly described on the platform, and we make no warranty about the accuracy of listings, profiles, scores, or badges.
13. Limitation of liability
To the maximum extent permitted by law, ClearSkai Technologies will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of SkaiApply. Our total liability for any claim is limited to the greater of $100 or the amounts you paid us in the twelve months before the claim arose.
14. Indemnification
You will indemnify ClearSkai Technologies against claims arising from your content, your use of the platform, your hiring decisions, or your violation of these Terms or applicable law.
15. Termination
You may close your account at any time. We may suspend or terminate access for violations of these Terms. Sections that by their nature should survive (including 8, 12, 13, and 14) survive termination.
16. Changes to these Terms
We may update these Terms. For material changes we will give notice (for example, by email or an in-product banner) before the new terms take effect. Continued use after the effective date constitutes acceptance.
17. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Arizona, and you consent to their jurisdiction.
